The Independent Record, Helena, Wednesday, March 25, 1987 SC Court revives federal sen discrimination case NATOON NOTCH I 1 WASHINGTON (AP) A federal appeals court says it finds evidence that the State Department has discriminated against women in the assignment and promotion of foreign service officers. The U.S. Circuit Court of Appeals, finding numerous legal and factual errors, revived 11-year-old sex discrimination claims rejected by U.S. District Judge John Lewis Smith Jr. in a 1985 ruling.

The district court unreasonably rejected a major portion of appellants evidence that the promotion decisions at issue were infected with a discriminatory motive," the three-judge appellate panel said in a 67-page opinion Tuesday. The unanimous opinion, written by Chief Judge Patricia Wald, found the State Department had discriminated against women in making two types of assignments and in the granting of a coveted performance award. The court, which found "a number of legal errors" and several clearly erroneous errors of fact, also ordered Smith to reconsider several other claims of sex discrimination in the hiring, promotion and assignment of foreign service officers. The State Department said in a statement that officials were not prepared to comment on the ramifications of the decision. The court panel suggested there was sufficient proof of discrimination in the areas it ordered Smith to reconsider.

Specifically, it found that there was ample evidence that a disproportionately low number of eligible women were assigned to senior programirection jobs. Unless the district court can find valid basis supported in the record for rejecting the inference of discrimination, it must rule in favor of the appellants on this claim, the court said. Because it has not been a high priority in the Department of Defense, the military services have not attempted to forecast or coordinate their requests to restrict airspace, said the GAO, the congressional watchdog agency. The result, the agency added, been the deployment of highspeed fighters to bases that dont have sufficient restricted airspace for training purposes, and have little prospect of obtaining rights to such airspace without touching off bitter fights with residents and the civilian aviation community. While offering a few caveats, the Pentagon agreed it was time to centralize planning and better define its needs for airspace. By July 1987, the Department Defense plans to develop a directive that will require the services to develop and maintain airspace plans, use these plans to help make aircraft basing and mission decisions and share these plans with the Federal Aviation Administration and affected states, the Pentagon wrote the GAO.

"Airspace planning by the DoD, however, can only be effective if complemented by planning from other sectors of aviation. Some of the most disruptive changes to air traffic flows in recent years have been the result jof unilateral airline decisions to centralize the flow of their aircraft through designated regional airports or hubs." The 27-page audit by the GAO, initiated on its own authority last year, was published Monday. It paints in bleak terms a problem that has become only too real to rural residents in recent years, particularly in the West: too little airspace to accommodate the Pentagon's demands for low-flying, fast-moving jets.
