-t Annual Convention of Retail Merchants in Billings, June 25 I- i i I I Drs. Ov.ea& Hater DENTISTS Uoun 9 to 5 Bailey Block i Closed Saturday Afternoons During Summer Months tax returns for' the fiscal year beginning July 1, 1923 and ending June 30, Forms are now available on which to file these returns, and have been mailed to all corporations who filed for the fiscal year ending June 30, 1923, Capital stock tax is a special tax payable in advance for the privilege of doing business for the next fiscal year ending June 30; 1924. The rate of tax is on each full $1,000 of the total value of a corporations capital stock for the preceding fiscal year ending June 30, in excess of $5,000. The amount of $5,000 is an arbitrary exemption allowed all corporations. Every corporation whether do mestic or foreign, must file a return, even though it carries no tax due.

The term corporation includes associations and joint stock companies. All corporations claiming exemption, must file a return, the determination of liability rest ing with the commissioner of internal revenue, at Washington. If any company was not engaged in business an affidavit should be attached explaining the companys activities. The, return is due on or before July 31, 1923, to avoid the penal-, ties for delinquency. Any corporation which fails to make a return within the required time is liable to a penalty not to exceed $1,000.

In case of failure to file a return on time a 25 percent penalty of the amount of tax. ia added, to it. The tax due on a return payable when the return is filed, or on ten days notice and demand from the collectora office.4. Returns should be filed at the earliest possible moment, thus avoiding the assertion of any penalties for i delinquency which are frequently incurred through oversight resuting from failure to file returns promptly. Do not confuse this tax wfh any form of income tax, nor get the impression that this particular tax ha! previously been paid.

"This years annual' convention of the' Retail Merchants association of Montana promises one of the best meetings In spirit and attendance of Its existence, says O. L. Breckman, treasurer and director. "The association has more than trebled Its membership In the past months, and the working Interest of retailers throughout Montana In assisting the officers In carrying out the program established at last years convention, has placed the Montana association at the fore of merchants organisations in the west For the most effective continuance of this program, the officers have decided to Initiate at this meeting the group luncheon Idea, whereby merchants of the same business may, without interruption, discuss the questions Imminent tt their particular branch, these luncheon meetings to establish the nucleus of definite trade sections, thus rendering it possible for the organisation to be of even greater specialised service to the individual and the unification of every branch of 'the merchandising fraternity. The complaint of Anna Rosenfeld against the' state game and fish warden, filed in the Cascade county district court is held to be insuffi cient and the action of the lower courtin sustaining a demurrer to fhe complaint is found to be a correct ruling in a decision of the state supreme court handed 1 down yesterday.

The opinion of the court is written by Associate Justice Holloway. Anna Rosenfeld sued the game warden to regain possesion of Beaver pelts alleged to be worth $2,500. The lower court sustained the demurrer upon the ground that the facts stated in the complaint were not sufficient to constitute a cause of action that the complainTittan ordinary, case would, be sufficient 'but because the possession of the pelts of wild animals is prims facie evidence that the person possessing same has killed the animals unlawfully requires the person in possession to prove the fact that they were not killed unlawfully, there fore the complaint should of 'alleged thf possession' iri a lawful manner and-how obtained.
